Why do agents leave with clients so often?
It is usually the result of how the brokerage is set up, not one act of disloyalty. Four patterns cause most of it:
Personal WhatsApp numbers. The chat history, voice notes and budget talk sit in an app that belongs to the agent. The client saves that number, not yours.
Personal phones. Contacts sync to the agent's own Google or iCloud account, along with photos of IDs and title deeds.
Private spreadsheets. The "real" pipeline lives in a Google Sheet because the office CRM is slow or nobody checks it. That sheet is the list they take.
Portal leads routed to the agent. If Property Finder, Bayut or Dubizzle leads go straight to an agent's mobile or email, the brokerage has no record the lead existed.
Who owns the client when an agent leaves a Dubai brokerage?
Start with an honest point: nobody owns a client. Buyers and landlords can choose any licensed broker, and if a client decides to follow an agent, you generally can't stop them. What the brokerage can protect is its client data, listing agreements and business relationships.

Non-compete clauses under UAE Labour Law
Article 10 of Federal Decree-Law No. 33 of 2021 allows a non-compete where the job gives the worker knowledge of the employer's clients or access to its work secrets. It must be limited in time, place and type of work, and can't run for more than two years after the contract ends. Several limits matter for brokerages:
It falls away if the employer ends the contract in breach of the law.
The employer has to prove the damage, and a claim won't be heard once a year has passed from discovering the breach.
Under the Executive Regulation, the agent is exempt if they or their new employer pay compensation of up to three months' wage, with your written consent. With a low basic salary and high commission, that buy-out can be small.
A client non-solicitation clause is narrower: it doesn't stop the agent working in real estate, only approaching your clients for a set period. Article 16 of the same law already requires workers to keep work information confidential and return items in their custody when they leave.
The PDPL: the brokerage decides how client data is used
The UAE's Personal Data Protection Law, Federal Decree-Law No. 45 of 2021, calls the party that decides the purpose and method of processing personal data the controller. When an agent collects a buyer's details to find them a property for your brokerage, the brokerage usually decides why and how that data is used. That is the case for treating the client database as a brokerage asset, and it also puts duties on you to keep that data secure.
Form A and ad permits sit with the brokerage
DLD's Real Estate Brokerage Practice Guide defines Contract A as an agreement to market a property between the seller and the real estate brokerage, and requires brokerages to obtain a Trakheesi permit for every ad. Listing mandates and permits don't go with the agent.
